The patent registration laws of a country are applicable only to the jurisdiction of that particular country. The UAE has its own set of patent laws regarding the registration. The MoE or Ministry of Economy is the government authority is the supreme authority who is in charge of patent registration in the country. By the law, an inventor can protect their patent from being mishandled or misused.

What you mean by Patent Registration?

A patent law or Patent Registration is introduced or used to protect innovation and inventions through which the groundbreaking technologies and ideas gets a support to their efforts in research, work and cost. Moreover, through patent registration, the original inventor receives all the legal credits and benefits of the invention.

UAE Patent Law: United Arab Emirates is always stick to its rules and provides exclusive rights to the needy citizens as well as residents. Intellectual property rights are protected in the UAE through a set of federal laws. The patent law also grants rights to those individuals or entities who are responsible for the particular inventions. There are certain terms and conditions stated by the law which is to be met before applying the patent registration. The necessary conditions are:

  1. The invention should carry a scientific elucidation
  2. The invention should be unique
  3. The invention’s industrial point of use should be evident

If the conditions are met, patent registered innovation or invention cannot be commercially made, used, distributed, imported or sold by others without the patent owner’s consent.

How much is the validity of a Patent Law?

A patent is valid for 20 years from the date of application or from the date of international filing. A patent is granted for every new invention arising from an innovative idea or innovative improvement that represents a creative step and is industrially applicable.

When a patent will not be granted?

A patent will not be granted to those innovations or inventions of:

  • Discoveries of new plant or animal species and biological methods of animal or plant production, except scientific methods of microbiology and microbiological products, as per the executive regulation of the law.
  • Human or animal diagnosis, treatment or surgical methods
  • Scientific principles, discoveries, theories and mathematical methods
  • Rules, plans and modalities used in doing business or mental activities
  • Natural materials, except the method used for their extraction or purification.
  • Inventions that violate public order or morals, or harm human life, health or environment when they are used

What are the required documents to register your patent?

Those applicants who are residing inside UAE need to submit the following documents while applying for Patent Registration

  1. Personal information
  2. Claims (English and Arabic)
  3. Detailed description both in English and Arabic
  4. Drawing if applicable
  5. Abstract both in English and Arabic
  6. Power of Attorney (if applicable)
  7. Copy of emirates ID
  8. Certified copy of priority application
  9. Patent Cooperation Treaty (PCT) Documents (if available)

Those applicants who are residing inside UAE need to submit the following documents while applying for Patent Registration

  1. Personal information
  2. Claims (English and Arabic)
  3. Detailed description both in English and Arabic
  4. Transcript from commercial register or partnership
  5. Deed of assignment
  6. Power of Attorney
  7. Patent Cooperation Treaty (PCT) Documents (if available)

Once the documentation procedure is completed, we can apply for Patent Registration in UAE. The initial stage is to submit the duly filled patent registration form and make the necessary payment to the department. The approved application will then undergo certain verification procedures including examination. This is a time-consuming process and might take up to 42 months to get a patent registered. After completing the verification, the application will be published and within completing the publication time frame any 3rd party can raise an objection against the patent approval. If the half-done application is having objections and doesn’t fulfill the requirements to overcome, the patent will be rejected and the fee paid will be non-refundable.
